DIGITAL MILLENNIUM COPYRIGHT ACT (DMCA) COUNTER-NOTIFICATION

If you received a Digital Millennium Copyright Act (“DMCA”) (17 U.S.C. §§ 512, 1201–1205, 1301–1332; 28 U.S.C. § 4001) infringement notice and believe it was submitted in error, you may submit a DMCA counter-notification. The counter-notification must be submitted by Web Hosting Hub, Inc.’s ( “Company”) customer or customer’s authorized agent.

Pursuant to Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity was removed or disabled by mistake or misidentification may be subject to liability.

A counter-notification must include all of the following:

  1. Your name, address, phone number and physical or electronic signature;
  2. Identification of the allegedly infringing content and its location before removal or disabling of access;
  3. A statement under penalty of perjury that you believe in good faith that the content was removed by mistake or misidentification; and
  4. TA statement that you consent to the jurisdiction of the U.S. Federal District Court for the judicial district in which you are located (or if you are outside the U.S., for any judicial district in which Company may be found), and that you will accept service of process from the person who originally provided us with the Infringement Notice (the “Copyright Holder”) or an agent of such person.

Please note that perjury is deliberately giving false testimony; the act or crime of knowingly making a false statement (as about a material matter) while under oath or bound by an affirmation or other officially prescribed declaration that what one says, writes, or claims is true.
