Is WHOIS update a Transfer of Ownership?

If updating WHOIS data indicates a transfer of ownership and shuts down access to the site for 60 days, why would I do this? I can't afford to not have access to my site for 60 days. I'd like to be compliant, but not if it means 60 days of no access.
Please help!

Hello,

Thank you for your question regarding updating WHOIS and transferring ownership. Updating your WHOIS record does not shut down access to the site. The ICANN rules for transferring your domain state that you cannot transfer the domain to another Registrar for 60 days.

But you can still continue to access and use your site during this time.
